Job Description: The U.S. Department of Health & Human Services (HHS), Office of the General Counsel (OGC), Centers for Medicare & Medicaid Services (CMS) Division, has immediate openings for senior staff attorneys in the Washington, D.C. or Baltimore, MD offices. CMS Division attorneys provide a broad range of legal services for several of HHS’s grant and public benefits programs, including Medicare, Medicaid, CHIP, and select programs under the Patient Protection and Affordable Care Act (PPACA).
These positions are in our Program Integrity Group. Attorneys in the Program Integrity Group work closely with the Office of the Inspector General and the Department of Justice on matters relating to health care fraud enforcement activities. Program Integrity attorneys also advise the Department and client agencies on matters arising under the Department’s various program integrity and enforcement authorities, including authorities governing provider revocations, suspensions, terminations, and enrollment; open payments; EMTALA; and application of the physician self-referral law and anti-kickback statute.
We are specifically seeking candidates with a strong foundational knowledge of the physician self-referral law and implementing regulations who can assist CMS in all phases of evaluating, drafting and issuing advisory opinions. Ideal candidates will have strong academic credentials, significant regulatory and administrative law experience(including, but not limited to, experience with the physician self-referral law), and superb writing skills.
We also have one position in our Program Review Group. Attorneys in the Program Review Group provide legal advice with respect to policies, regulations, guidance documents, national coverage determinations, model participation agreements, reports to Congress, and significant correspondence. Program Review attorneys advise CMSand HHS on a wide range of programs – most notably, Medicare, Medicaid, CHIP,CLIA, and PPACA title I – and subjects, including Innovation Center payment and service delivery models, Medicare payment, quality reporting and incentive programs,HIPAA, health information technology, and Medicaid policies and demonstrations.
