Commercial Unit Attorney - Procurement Policy – 13601 Civil Service Title: Agency Attorney Level: Level 3 Division/Office: Office of the General Counsel Borough: Manhattan Posting End Date: 04/30/2023 Description: AMENDED Position Summary: Under the direction of the Deputy Counsel of the Legal Services Commercial Unit, the Commercial Unit Attorney-Procurement Policy exercises independent judgment pertaining to the negotiation, drafting, and review of important legal contracts and agreements having significant financial, procedural, or policy consequences. This attorney will provide analysis and support on drafting and implementation of State and City regulations and policy pertaining to public procurement. Performs related work. Reports to: Deputy Counsel, Legal Services Direct Reports: N/A Key Relationships: Office of Financial Operations, Office of Capital Budgets and Grants, Division of Information and Instructional Technology, vendors, and other internal and external offices as assigned. Responsibilities · Negotiates and drafts complex contracts and agreements for a wide range of goods, services, and equipment. · Work with New York City Law Department to draft policy for a Minority and Women-Owned Business Enterprise (MWBE) procurement program for the Department of Education. · Act as primary contact for legal issues surfacing in managing the MWBE procurement program. · Provides legal advice on the legal sufficiency of procurements and assists in providing legal advice in bid protests. · Assists in the development of procurement policies and procedures for the Department. · Advises on basic copyright, intellectual property and data privacy/confidentiality questions. · Serves as liaison in commercial litigation cases. · Reviews RFP's, proposals, and contracts, and recommends solutions to mitigate project risks. · Drafts, reviews, and negotiates multi-year standard (form) and non-standard contracts, including software licenses and professional service agreements. · Drafts rules and regulations for the Department of Education. · Analyzes and reports on the effects of City, State, and Federal legislation. Qualification Requirements Minimum Admission to the New York State Bar AND three (3) years of progressively responsible United States legal experience subsequent to admission to any state bar. All candidates must be able to demonstrate commercial or transactional legal experience. Incumbents must remain members of the New York State Bar in good standing for the duration of this employment. Note: In addition to meeting the minimum Qualification Requirements: To be assigned to Assignment Level III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. Preferred · Five (5) years’ experience negotiating and drafting contracts. · Knowledge of public procurement. · Ability to rapidly understand provisions of applicable law and regulations. · Ability to write clearly and concisely. · Efficient research skills. · Ability to conduct or coordinate highly complex legal research efficiently and on tight deadlines. · Ability to advise and render legal opinions on procurement policies and practices. · Ability to rapidly understand provisions of applicable law and regulations in a fast-paced environment. Salary: $90,093-$98,000 (Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not earn less than their current salary.)
